Visas to work in Spain

If you belong to a country outside the EU, you must apply for a visa at the spanish embassy or consulate in your country. All foreign entrepreneurs who wish to enter Spain to work need to have a visa of this type if they are not citizens of the European Union, Iceland, Liechtenstein, Norway or Switzerland. The long-term visa application must be submitted to the spanish embassies or consular offices abroad. At the time of submitting the visa application, the fee must be paid, with no provision for its refund if the application is denied. In case of denial of the visa, a contentious-administrative appeal may be filed before the Superior Court of Justice of Madrid.

Digital Nomad Visa in Spain. According to Law 28/2022, of December 21, the visa for teleworkers was established in Spain in 2022 with the purpose of establishing a new visa category for international workers, providing them, together with the Entrepreneurs Law (commonly known as the Startup Law), with advantages regarding the payment of taxes, acquiring a permanent residence permit and the option of including the family in a future application for a residence visa. The Spanish government aims to attract qualified talent and international capital with the purpose of strengthening the national economy. This is also part of its strategic plan to position itself as a leader in the ranking of countries with the greatest talent, innovation and digital entrepreneurship. The visa for international teleworking allows entry and residence in Spain for a maximum of one year while its holders work for themselves or for employers anywhere in the world. Furthermore, the residence permit for international teleworking allows foreigners who are already legally in Spain, for example, those who are studying in Spain or those who, being holders of a teleworking visa, are going to exhaust said year of residence and want to continue in Spain, to request an authorization for a maximum period of three years, renewable for a period of two years, being able to obtain permanent residence after five years.
